The service and the operator

Powerland Map is operated by THE PLATFORM COMPANY, French single-member simplified joint-stock company (SASU), SIREN 106 140 981 — RCS Paris, 47 rue Vivienne, 75002 Paris, France, VAT FR85106140981. The service publishes market intelligence on data centre supply, anonymised demand and evidence-based matching. Access to the terminal is vetted; each subscription’s scope is defined by the corresponding plan or order form. Contact: matthieu@powerlandmap.com.

Data accuracy and limits of the information

The operator takes reasonable care in collecting, verifying and updating data. Each item reflects its sources as of its verification date; completeness, accuracy and freshness are not guaranteed. Errors, omissions or delays may result from the limits of public or third-party sources and their updates.

Reported or sourced capacity is distinguished from estimated or modelled capacity, with a confidence level. Announced, requested, reserved, contracted and deliverable MW are not equivalent, nor are power MW and IT MW. Proximity to a network does not mean available grid capacity and guarantees no connection, permit, land title or availability, delivery date or cost.

Demand signals and supply-demand matches are not a verified commitment, order, letter of intent, offer, off-take agreement or guaranteed transaction. CAPEX, OPEX, price data and forecasts are indicative and promise no return.

No advice and independent due diligence

The service provides market information, not investment, legal, tax, financial or engineering advice, and does not guarantee suitability for any particular purpose. The subscriber carries out its own technical, legal, financial and commercial due diligence before any decision. Third-party links and content are provided for information and are not endorsements.

Errors can be reported to matthieu@powerlandmap.com; the operator reviews them and corrects confirmed errors within a reasonable time.

Availability, accounts and security

The service may be interrupted for maintenance, updates or because of third-party providers (hosting, network, payment). No availability level is guaranteed unless a service level is set in the order form. The subscriber keeps its credentials confidential, limits use to authorised seats and promptly reports any suspicious access.

Intellectual property, confidentiality and personal data

The platform and database remain the operator’s property; only the licence described above is granted. Removing or obscuring source, confidence or verification indications attached to records is not permitted. The operator acquires no rights in the subscriber’s own data, documents or know-how. Each party keeps the other’s non-public information confidential. Personal data is processed as described in the privacy policy (/privacy).

Commercial terms

Subscription prices are quoted exclusive of VAT. Price, term, minimum commitment, billing, renewal and termination are those of the plan or order form actually accepted; these terms do not change existing commercial commitments.

Force majeure

Neither party is liable for a failure caused by force majeure within the meaning of article 1218 of the French Civil Code. The affected party gives prompt notice and makes reasonable efforts to mitigate. Performance is suspended while the impediment lasts; if it lasts more than sixty days, either party may terminate by written notice, and amounts covering any period not provided are refunded pro rata.

Liability

Each party is liable for proven direct damage resulting from its breaches. To the extent permitted by law, the operator is not liable for indirect loss such as loss of revenue, profit, opportunity or data. Its total liability is capped at the fees paid for the relevant service during the twelve months preceding the event giving rise to the claim; where the subscription is less than twelve months old, the cap is the fees payable for the first twelve months of the subscription.

These limits do not apply to fraud (dol), gross or wilful misconduct, bodily injury or any liability that cannot legally be limited. They do not deprive the essential obligation of its substance (French Civil Code article 1170) and do not create a significant imbalance (French Civil Code article 1171 and Commercial Code article L442-1). A separately negotiated contract may set different limits.

Governing law and general provisions

These terms are governed by French law. Disputes between businesses fall within the jurisdiction of the competent courts of Paris, subject to applicable mandatory rules. If a clause is held invalid, the others remain in force. Failure to enforce a breach is not a waiver. The signed order form or contract prevails in case of conflict.

Each new version is published with its effective date, applies prospectively only and must be expressly accepted; it has no retroactive effect on events before its acceptance. A subscriber who does not accept a material change may end the subscription under the order form; earlier acceptances remain on record.
